The ESFA has issued a reminder to providers about the contractual requirement to give ESFA 12 weeks’ notice, of any notice of intended, or proposed change of control/ownership of the contractor. The ESFA will undertake appropriate due diligence checks once notified to consider whether the change is permissible, under Regulation 72 of the Public Contracts Regulations, and/or in breach of RoATP Conditions of Acceptance and/or in breach any other ESFA policies or contractual requirements. You can contact them via the ESFA enquiry form if you have any queries relating to this.
